Athletic apparel maker Lululemon Athletica has filed a lawsuit in the U.S. District Court for the Central District of California against wholesale retailer Costco Wholesale Corp., alleging that Costco’s private-label and partnered brands are selling “knockoff” versions of Lululemon’s signature designs. The complaint, filed on June 27, claims the retailer’s Kirkland Signature line and products from Spyder and Danskin closely mimic Lululemon’s Scuba hoodies, Define jackets, and ABC pants.
In its 49-page complaint titled Lululemon Athletica Canada Inc. v. Costco Wholesale Corp., Lululemon asserts trade dress infringement and patent violations. The company provided side-by-side images to demonstrate “confusingly similar” styling, fabric details, and seam placements. Lululemon is seeking monetary damages for lost profits, compensation for patent infringement, and a court order to halt further production and sales of the contested items.
“Consumers are being misled into believing these products are authentic Lululemon apparel,” the filing states. Attorneys Ali Razai and Brandon Smith of Morgan Lewis & Bockius represent Lululemon, while Costco’s legal counsel has not yet responded. Lululemon notes it previously settled similar disputes with Peloton in 2022 and Calvin Klein in 2012, underscoring its commitment to protecting its designs.
If granted, Lululemon’s requested injunctive relief would require Costco to cease manufacturing, importing, marketing, and selling the allegedly infringing products. The case is set for jury trial, with Lululemon seeking full restitution and an end to what it describes as “unauthorized dupes” of its premium apparel.
